GENERAL TERMS AND CONDITIONS OF CONTRACT

1. Scope

The following general terms and conditions of EMPRENDIMIENTOS HOSTELEROS VALENCIA (hereinafter, “EHV” or “The Holder”), are applicable to your order or booking in the version in force at the time of contracting the service.

The terms and conditions apply exclusively to contracts made through the Internet portal and shall comply with the provisions of current legislation and, in particular, with Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

2. Identification of the Holder

The address for the purpose of complaints shall correspond to the address indicated as the Holder’s address.

3. Object

The present general contracting conditions (hereinafter, the “Conditions”) regulate the contracting of the services that are offered through the EHV Web Page as well as the rights and obligations of the parties, derived from the service provision operations agreed between them, more specifically, the reservation of rooms, as well as reception and catering services.

4. Registration on the Website by Users / Customers.

Registration on the Website must be carried out by persons of legal age. By creating a Customer or User account, or by contracting any service, the User agrees to be responsible for the data he/she submits and the services he/she offers, which shall not be offensive and may not contradict applicable legislation.

Such data shall be kept up to date, and the User shall ensure the security of his/her Customer/User account and access credentials, and shall be solely responsible for the activities carried out through his/her account.

Of course, the User shall not use or impersonate another person’s account or provide false information through his/her account in order to mislead others. Any such conduct shall entitle the Holder to cancel his/her account, without prejudice to any legal action he/she may deem appropriate.

Any unauthorised use of your account must be immediately notified to EHV by the User.

5. Service contracting

The contracting of a service through the EHV Website implies the acceptance by the Client / User of all the conditions stipulated in this document.

When the Customer / User contracts a service or makes a booking, and enters into an agreement with EHV, the price and conditions will be indicated in advance before any payment is made.

6. Contracting process

The contracting of a service through the EHV Website implies the acceptance by the Client / User of all the conditions stipulated in this document.

When the Customer / User contracts a service or makes a booking, and enters into an agreement with EHV, the price and conditions will be indicated in advance before any payment is made.

6. Contracting process

6.1. Bookings and reservations.

  • EHV offers you the possibility to book hotel rooms and make restaurant reservations.
  • Once the booking has been made, the client will receive a confirmation with details of the booking, prices, cancellation conditions and other relevant information, at the email address provided when making the booking.
  • Check-in and check-out times will be specified at the time of booking and may vary according to availability. Additional charges may apply for unscheduled late departures.
  • Once you have made your booking online on the EHV website, you will receive a booking confirmation with full details of your booking, contract, rates, cancellation policy and any other relevant information.

In order to contract the services offered by EHV, you must fill in the fields with the required data and accept these Terms and Conditions. This acceptance shall signify the express, full and unreserved agreement to the entirety of the general conditions set out in the version published by EHV and shall be binding on both parties.

EHV will ensure that all services offered have the necessary legal coverage, quality guarantees and, where appropriate, insurance.

To make payments for services, EHV may use external providers such as payment gateways and other transaction processors. Each of these has its own conditions and policies. All transactions will be carried out through secure payment platforms that totally guarantee the confidentiality of your data.

7. Prices

The price of the products / services is the price indicated at any given time on the Website.

The prices shown do not include VAT or the corresponding territory-specific taxes.

8. Pricing error

If an error is detected in the introduction of the price after the purchase by the Client, EHV must inform the Client as soon as possible of the incident and offer the option of cancellation or maintenance under the correct conditions.

The automatic confirmation remission does not validate erroneous price conditions. In case of cancellation, any amount paid by the Customer will be refunded.

The definitive price will be the price in force in the advertising coinciding with the moment of formalising the reservation, without prejudice to any updates that may take place.

The Proprietor makes every effort within its means to provide accurate and typographical error-free information on its Website.

9. Other costs

In the event that there are additional costs for the service, they will be communicated to the Client and itemised in the final price prior to the payment of the service contract.

10. Right of withdrawal

Pursuant to Article 103. l) of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users, the right of withdrawal will not be applicable to contracts that refer to the supply of accommodation services for purposes other than the provision of housing, food or services related to leisure activities, if the contracts foresee a specific date or period of performance; therefore, if the User unilaterally cancels the contract, he/she will not be entitled to a refund of the amount paid for the reservation, without prejudice to the fact that EHV may voluntarily offer free cancellation or the option to modify his/her reservation for other dates.

Where applicable, the amount and method of refunding payments during the term of the contract, in the event of termination or breach of the contract, shall be paid as agreed by the parties, without such refund having to be made compulsorily through the Website.

11. Duration of the contract

The term of the contract shall be subject to the duration agreed by the parties, but shall generally extend to the period of time between the booking of the room or service and the end of your stay at the place where you have booked.

12. User obligations

All Clients or Users of EHV must make correct use of our Web Page, as well as of our facilities, making themselves solely responsible for any possible damages that may be caused to EHV or to third parties due to their lack of diligence or fraudulent actions. Parents shall be equally responsible for supervising their children at all times, exonerating EHV from any liability for accidents or damage caused by unsupervised children.

The Customer / User hereby accepts responsibility for the truthfulness and accuracy of the data and information provided to us as a result of the online service contract.

EHV reserves the right to restrict or deny the provision of a service to the Client / User in the event that it becomes aware that said Client / User has breached the contracting conditions, the general conditions of use of the Website, the privacy policy, as well as any other particular condition that may be agreed.

13. Disclaimer

EHV shall not be liable for any misuse carried out by Customers / Users registered on the Website. In this sense, any damage caused to third parties of any kind, loss, theft or damage to guests’ property, whether in the rooms, in the restaurants, in the common areas or in the car parks, shall not be the responsibility of EHV. Customers are also responsible for their personal effects.

EHV shall not be liable in situations beyond its control, such as strikes, natural disasters or technical breakdowns, which may cause booking disruptions or cancellations.

EHV is also not responsible for any illegal activities that may be carried out through the Website, and Clients must respect the rules of the establishment, including the rules of conduct. Any inappropriate, violent, disruptive or illegal behaviour may result in expulsion from the establishment without refund.

14. Industrial and intellectual property

The products or services we provide for booking through our Website are subject to copyright. In addition, logos, trademarks, texts, icons and other content subject to industrial and intellectual property rights are protected by the laws in force and applicable to the matter. The Rightholder has obtained the authorisation of the rights holder to make use of these contents or materials.

15. Conflict resolution

Any disputes that may arise between the Client / User and EHV as a result of a breach of the contracting conditions shall be governed by the provisions of current legislation, with the rules of the Spanish legal system being applicable.

If any provision of these terms is held to be invalid or unenforceable, such provision shall be deemed severable and shall not affect the validity of the remaining provisions.

We inform you that there is a European platform for online out-of-court settlement of disputes concerning contractual obligations arising from sales or service contracts concluded online between a consumer and a trader resident in the European Union, through the intervention of an ADR entity.
